By accessing, browsing, or using our website at gurneeteservice.com (hereinafter referred to as the "Website"), mobile application, WhatsApp consultation services, or any of our online or offline service channels, you ("User," "Client," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (hereinafter referred to as the "Terms").

If you do not agree with any part of these Terms, you must immediately discontinue your use of our Website and services. Your continued use of our services following the publication of any modifications to these Terms constitutes your acceptance of such modifications.

These Terms constitute a legally binding agreement between you and Gurneet E Service, a business registration and digital solutions provider operating from offices in Sri Ganganagar and Nasirabad, Ajmer, Rajasthan, India. These Terms apply to all visitors, users, clients, and others who access or use our services.

By initiating a service request, making a payment, submitting documents, or communicating with our team through any channel, you expressly consent to these Terms and acknowledge that any service engagement is governed exclusively by these Terms.

Gurneet E Service provides a comprehensive range of business registration, compliance, and digital services designed to help entrepreneurs, startups, small and medium enterprises (SMEs), and established businesses across India.

Our Business Registration Services include but are not limited to: GST (Goods and Services Tax) Registration and compliance support, FSSAI (Food Safety and Standards Authority of India) License Registration for food businesses, Trademark Registration and intellectual property protection under the Trade Marks Act, 1999, MSME/Udyam Registration for micro, small, and medium enterprises, Company Registration under the Companies Act, 2013 (Private Limited, One Person Company), Limited Liability Partnership (LLP) Registration, and One Person Company (OPC) Registration.

Our Tax Compliance Services encompass: Income Tax Return (ITR) filing for individuals, businesses, HUFs, and firms, GST Returns filing including GSTR-1, GSTR-3B, GSTR-9, and GSTR-9C, Importer Exporter Code (IEC) registration for international trade, TDS/TCS return filing, and advisory on tax planning and compliance obligations.

Our Digital Services cover: Professional website design and development, e-commerce website development with payment gateway integration, Search Engine Optimization (SEO) for improved online visibility, digital marketing including social media management, Google Ads, and content marketing, business email setup, domain registration, and web hosting solutions.

The specific scope, deliverables, timelines, and fees for each service are communicated at the time of engagement and may vary based on the nature and complexity of the client's requirements. Government fees, statutory charges, and third-party costs are separate from our professional service charges and are communicated transparently before service commencement.

User Obligations

By engaging our services, you agree to fulfil the following obligations to ensure timely and accurate processing of your requests:

Accurate Information: You must provide true, complete, accurate, and up-to-date information in all communications, application forms, and submissions. Any false, misleading, or incomplete information may result in application rejection, penalties from government authorities, or legal consequences, and Gurneet E Service shall not be held liable for any such outcomes arising from incorrect information provided by you.

Valid Documents: You are responsible for providing all required documents in the format specified by our team. Documents must be legible, clear, and valid as of the date of submission. Expired, damaged, or illegible documents will not be accepted and may delay the processing of your application. Our team will guide you on the specific documents required for each service.

Timely Payments: All service fees must be paid within the agreed timeline. Failure to make timely payments may result in the suspension or cancellation of your service request without prior notice. Payment confirmations must be shared with our team to initiate the service process.

Cooperation: You agree to promptly respond to any queries, requests for additional information, or document clarifications raised by our team or by government authorities during the processing of your application. Delays in your response may extend the processing timeline beyond the estimated period.

Authentication: Where required by government portals or regulatory bodies, you must provide OTP verifications, digital signatures, or other authentication mechanisms from your registered mobile number or email address. Gurneet E Service cannot complete these steps on your behalf without your active participation.

Compliance: You agree to comply with all applicable laws, regulations, and guidelines governing your business activities. Our services are limited to registration, filing, and compliance facilitation, and do not absolve you of your statutory obligations as a business owner or entity.

Fee Structure & Payment

Pricing Transparency: All service charges are clearly displayed on our Website and are communicated to you in writing (via email, WhatsApp, or official communication) before the commencement of any service. The quoted price includes our professional service charges for the specific scope of work agreed upon. Government fees, statutory charges, portal fees, and any third-party costs are additional and payable separately unless explicitly stated otherwise.

Payment Methods: We accept payments through the following methods: UPI (Unified Payments Interface) including Google Pay, PhonePe, Paytm, and BHIM UPI, NEFT/RTGS/IMPS bank transfers to our official bank account, credit and debit cards (Visa, Mastercard, RuPay) through our secure payment gateway, net banking from all major Indian banks, and in select cases, cash payments at our office locations.

Payment Timeline: Full or partial payment as agreed must be made before the commencement of service processing. For services with multiple stages, milestone-based payment schedules may be agreed upon and communicated in advance.

Invoice: An official invoice will be issued for every payment received. You are advised to retain the invoice for your records and for potential tax deduction purposes. GST will be charged on our service fees as applicable under the current GST laws of India.

Price Changes: Gurneet E Service reserves the right to revise pricing for services at any time. However, any price change will not affect service engagements that have already been confirmed and paid for. Revised pricing will be applicable only to new service requests made after the effective date of the change.

Service Process

Our service delivery follows a structured and transparent process to ensure quality, accuracy, and timely completion:

Step 1 - Consultation: Upon receiving your service request, our team conducts a detailed consultation to understand your requirements, eligibility, and the most suitable service plan. This may be conducted via phone call, WhatsApp, video call, or in-person meeting at our office.

Step 2 - Document Collection: Our dedicated consultant will provide you with a comprehensive list of required documents. You must submit all documents in the specified format within the agreed timeline. Our team verifies each document for completeness and accuracy before proceeding.

Step 3 - Application Preparation & Filing: Upon receipt and verification of all documents, our expert team prepares the application, fills in all required forms on the respective government portal, and submits the application on your behalf. An Application Reference Number (ARN) or acknowledgement number is shared with you upon successful submission.

Step 4 - Follow-Up & Status Tracking: Our team monitors the status of your application with the respective government department and follows up regularly. Any queries raised by the authorities are communicated to you promptly, and we assist in resolving them to ensure smooth processing.

Step 5 - Certificate Delivery: Upon successful approval and issuance of your registration certificate, licence, or other deliverables, the same is shared with you via email and/or WhatsApp in digital format. Physical copies, if applicable, are dispatched to your registered address via courier or available for collection at our office.

Timelines mentioned for any service are indicative and based on standard processing times observed for government applications. Actual processing times may vary depending on the workload of the concerned government department, completeness of documents, and any additional queries raised during verification. Gurneet E Service shall not be held liable for delays caused by government processing timelines or circumstances beyond our control.

Refund & Cancellation Policy

We understand that circumstances may change, and we have designed our refund and cancellation policy to be fair and transparent. Please review the following terms carefully before engaging our services:

Cancellation Before Filing: If you wish to cancel your service request before your application has been filed or submitted on any government portal, a partial refund may be considered. The refund amount will be calculated after deducting any administrative costs, consultation fees, document verification charges, and any other costs incurred in processing your request up to the point of cancellation. Such cancellation requests must be communicated in writing (via email) within 24 hours of payment. The decision on refund eligibility and amount is at the sole discretion of Gurneet E Service.

No Refund After Filing: Once your application has been filed or submitted on any government portal, NO REFUND will be provided under any circumstances. This is because the government fees, portal charges, and our professional service charges for application preparation and filing are fully consumed at the time of submission. This applies to all services including but not limited to GST Registration, FSSAI Registration, Trademark Registration, Company Registration, LLP Registration, OPC Registration, MSME Registration, IEC Registration, ITR Filing, GST Returns Filing, and all digital services.

Service-Specific Terms: For website design and development services, cancellation is possible only before the design phase has commenced. Once design mockups have been approved by you and development work has started, no refund will be provided. For digital marketing services (SEO, social media management, paid advertising), cancellations will be effective from the end of the current billing cycle, and no pro-rata refund will be provided for the remaining period. For ongoing compliance services (monthly GST return filing, quarterly TDS filing), cancellation must be communicated at least 7 days before the next filing due date.

Refund Processing: Approved refunds, if any, will be processed within 7-15 business days via the original payment method. Bank transfer refunds may take an additional 3-5 business days to reflect in your account.

Disputes: Any disputes regarding refunds must be raised within 7 days of the cancellation request or payment, whichever is later. Claims raised after this period will not be entertained.

Confidentiality & Data Protection

At Gurneet E Service, we treat your personal and business information with the highest level of confidentiality and are committed to protecting your privacy.

Data Collection: We collect personal information (name, email, phone number, address, PAN, Aadhaar), business information (business name, registration details, financial records), and documents (identity proof, address proof, business registration documents, bank statements) solely for the purpose of providing our services as requested by you.

Data Usage: Your information is used exclusively for: processing your service requests, communicating with you regarding your applications, filing applications on government portals on your behalf, maintaining service records and providing customer support, and improving our services and user experience.

Data Protection: We implement industry-standard security measures to protect your information from unauthorized access, alteration, disclosure, or destruction. All documents shared with us are stored securely and accessed only by authorized personnel directly involved in processing your service request. We do not sell, rent, trade, or share your personal information with any third party for marketing or commercial purposes.

Government Portals: When filing applications on government portals, certain information must be provided as mandated by the respective regulatory authority. Such disclosure is governed by the applicable government regulations and is beyond our control.

Data Retention: We retain your documents and information for the duration necessary to fulfil the service engagement and as required by applicable laws. Upon your written request, we will securely delete your personal documents from our systems within 30 days, subject to any legal or regulatory obligations to retain such records.

Your Consent: By submitting your documents and information to us, you consent to the collection, storage, processing, and use of your information as described above in connection with the provision of our services.

Intellectual Property Rights

All content, materials, and intellectual property displayed on the Website and associated with our services are the exclusive property of Gurneet E Service or its licensors and are protected by applicable Indian and international intellectual property laws.

This includes but is not limited to: the Website design, layout, graphics, logos, icons, and visual elements, all text content including service descriptions, articles, blog posts, and guides, proprietary tools, templates, forms, and checklists provided as part of our services, the "Gurneet E Service" name, logo, taglines, and brand elements, and any software, code, or technology underlying the Website and our digital services.

You are prohibited from: reproducing, copying, distributing, publishing, displaying, modifying, or creating derivative works from any content on the Website without prior written consent from Gurneet E Service, using our brand name, logo, or trademarks in any manner that could cause confusion or imply endorsement, scraping, crawling, or extracting data from the Website through automated means, and reverse-engineering any part of the Website or our digital services.

Client Deliverables: Upon full payment and successful completion of services, the ownership of registration certificates, licences, and government-issued documents is transferred to you as the rightful applicant. For website design and development services, ownership of the final website and its content is transferred to you upon full payment, subject to any third-party licenses (themes, plugins, images) used during development.

Limitation of Liability

Gurneet E Service provides professional services for business registration, compliance filing, and digital solutions. Our liability is limited as follows:

Scope of Service: Our services are limited to the preparation, filing, and facilitation of applications as described in the service engagement. We act as an intermediary between you and the respective government authorities and do not guarantee the approval, issuance, or outcome of any application. Approval of registrations, licences, or certificates is at the sole discretion of the competent government authority.

Liability Cap: In no event shall the total aggregate liability of Gurneet E Service, its directors, employees, agents, or affiliates exceed the total amount of professional service fees paid by you for the specific service in question during the twelve (12) months immediately preceding the event giving rise to the claim.

No Consequential Damages: Gurneet E Service shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of revenue, loss of business opportunities, business interruption, or financial loss arising from or in connection with the use of our services, Website, or any actions taken or not taken based on information provided on the Website.

Government Decisions: We are not responsible for any delays, rejections, additional requirements, or adverse decisions made by government authorities, regulatory bodies, or third-party agencies. While we strive to ensure accurate and complete applications, the final decision rests with the respective authority.

Information Accuracy: While we make every effort to ensure that the information on our Website is accurate and up-to-date, we do not warrant that the information is free from errors or omissions. Tax laws, regulations, and government procedures are subject to frequent changes, and users are advised to verify critical information independently.

Third-Party Services: We may engage trusted third-party vendors or partners for certain services (payment processing, courier services, etc.). Our liability does not extend to the actions, errors, or failures of such third parties.

Indemnification

You agree to indemnify, defend, and hold harmless Gurneet E Service, its directors, partners, employees, agents, contractors, and affiliates from and against any and all claims, demands, actions, suits, proceedings, losses, damages, costs, and expenses (including reasonable legal fees and attorney charges) arising out of or in connection with:

Any breach of these Terms by you, any misuse of our services, Website, or any materials provided as part of our services, any false, misleading, or fraudulent information provided by you during the course of service engagement, any violation of applicable laws, regulations, or third-party rights by you, any claim that your business activities or use of our services infringes upon the intellectual property rights or any other rights of a third party, and any dispute or legal action arising from the business activities conducted by you that were facilitated through our registration or compliance services.

This indemnification obligation shall survive the termination or expiration of these Terms and any service engagement between you and Gurneet E Service. We reserve the right to assume the exclusive defence of any claim subject to indemnification, and you agree to cooperate fully with our defence efforts.

Dispute Resolution

Governing Law: These Terms and any disputes arising out of or in connection with these Terms or our services shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Jurisdiction: Subject to the provisions below, all disputes shall be subject to the exclusive jurisdiction of the courts of Sri Ganganagar, Rajasthan, India. You hereby consent to the personal jurisdiction and venue of these courts and waive any objection to the inconvenience of these forums.

Amicable Resolution: In the event of any dispute, controversy, or claim arising out of or relating to these Terms or our services, you and Gurneet E Service agree to first attempt to resolve the dispute amicably through good-faith negotiations. Either party may initiate this process by sending a written notice to the other party describing the dispute in reasonable detail. The parties shall attempt to resolve the dispute within thirty (30) days of such notice.

Escalation: If the dispute cannot be resolved amicably within the 30-day negotiation period, either party may pursue legal remedies through the appropriate courts in Sri Ganganagar, Rajasthan, India, as specified above.

Interim Relief: Nothing in this dispute resolution clause shall prevent either party from seeking interim or injunctive relief from a court of competent jurisdiction to prevent irreparable harm or to preserve the status quo pending the resolution of the dispute.

Force Majeure

Gurneet E Service shall not be held liable for any failure, delay, or interruption in the performance of its obligations under these Terms if such failure, delay, or interruption is caused by circumstances beyond our reasonable control ("Force Majeure Event").

Force Majeure Events include but are not limited to: natural disasters (earthquakes, floods, storms, pandemics, epidemics), government actions (orders, directives, lockdowns, restrictions), changes in laws, regulations, or government policies, strikes, labour disputes, or industrial action, failure of government portals, servers, or digital infrastructure, internet outages, power failures, or telecommunication disruptions, war, terrorism, civil unrest, or political instability, and any other event or circumstance that is beyond our reasonable control and could not have been reasonably anticipated or prevented.

During the occurrence of a Force Majeure Event, we will use reasonable efforts to mitigate the impact on our services and will resume normal operations as soon as reasonably practicable. We will keep you informed of any significant disruptions and their expected resolution timeline.

If a Force Majeure Event persists for more than sixty (60) consecutive days, either party may terminate the affected service engagement by providing written notice to the other party. Any payments made for services not yet rendered shall be refunded in accordance with our Refund Policy, subject to deduction of costs already incurred.

Amendments to Terms

Gurneet E Service reserves the right to modify, amend, update, or replace these Terms at any time without prior notice, in order to reflect changes in our services, business practices, technology, legal requirements, or any other factors we deem appropriate.

Amendments will be effective immediately upon posting the revised Terms on our Website at gurneeteservice.com/terms. The "Last Updated" date at the top of this page will be revised accordingly. We may also notify you of material changes through email, WhatsApp, or a prominent notice on our Website.

Your continued use of our Website and services after the publication of amended Terms constitutes your acceptance of the revised Terms. If you do not agree with the amended Terms, you must immediately discontinue the use of our services and may request the termination of any ongoing service engagement.

Severability

If any provision, clause, or part of these Terms is found by a court of competent jurisdiction to be invalid, illegal, unenforceable, or contrary to any applicable law or regulation, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed and deleted from these Terms.

The severance of any invalid provision shall not affect the validity, legality, or enforceability of the remaining provisions of these Terms, which shall continue in full force and effect. The remaining provisions shall be interpreted as if the invalid provision had never been contained herein.

The parties agree that any such invalidity shall not affect the overall intent and purpose of these Terms, and the remaining provisions shall be given full effect to the greatest extent permitted by law. This severability clause shall survive the termination or expiration of these Terms.
