What is the difference between a Society and a Trust?
A Society is registered under the Societies Registration Act, 1860, and is governed by a governing body or managing committee elected by its members. Societies are ideal for charitable, educational, cultural, and literary activities. A Trust (Public Charitable Trust) is registered under the Indian Trusts Act, 1882, and is managed by trustees. FCRA registration is mandatory for any NGO, society, or trust that wishes to receive foreign contributions, donations, or grants from foreign sources including individuals, companies, foundations, and multilateral agencies. How many members are needed to register a society?
A minimum of 7 members is required to register a society under the Societies Registration Act, 1860. All 7 members must sign the MOA and be present as subscribers to the society. For a trust, a minimum of 2 trustees is sufficient. The governing body typically consists of a president, vice-president, secretary, treasurer, and other members as defined in the rules and bye-laws. There is no maximum limit on the number of members a society can have. All members must be Indian citizens and at least 18 years of age.
